Construction Update on Finnegan's Parklet

Renovation work began on the Finnegan's Dining Deck Monday, October 22. Thank you for your patience and understanding with any noise and dust during construction.

The project includes modifying the fencing on the west side of the deck in front of Celine's Candy and Mantra Wine to more closely match the existing fencing on the sidewalk; and, removing and modifying the fencing along the sidewalk; review site plan here.

The west end of the deck will be a public parklet with benches and planters that is open for public use and enjoyment. The Finnegan's Deck has been reconfigured and reduced in size.

Background Information 

Agreement between the City, Finnegan's, and Uhlmann

In February 2018, City staff issued an encroachment permit and license agreement to Finnegan’s of Marin to install an outdoor dining area (“Parklet”) in the City right-of-way on Grant Avenue. Following the construction of the outdoor dining area, the City received some complaints regarding the construction of the outdoor dining area in the right-of-way.  Additionally, Finnegan’s and the City received a complaint from the adjacent property owner objecting to the process for the approval and the location of the outdoor dining area in front of his building at 879-881 Grant Avenue (where Celine’s Sweets and Mantra Wines is located) and advising of his intent to take legal action. 

To avoid costly and uncertain litigation, the City worked with Finnegan’s and the adjacent property owner to reach a settlement of the dispute—which was agreed to by all parties--and an agreement was executed on July 12. The parties agreed that the portion of the outdoor dining area located in front of the 879-881 Grant Avenue building would be modified by the City and at the City’s expense and would be available for use by the public.  

The portion of the outdoor dining area in front of the Finnegan’s building will be expanded onto the sidewalk—also at the City’s expense--and will be available for use by Finnegan’s for outdoor dining. 

The City Council is very supportive of private sector improvements in our Downtown and has directed staff to come back with options for the development of a formal process for future outdoor dining and/or Parklet projects in the right-of-way.  Staff is currently working on this effort and anticipates bringing an item before the City Council for consideration this fall.
